Job Details
DUTIES AND RESPONSIBILITIES:
- Prepare loan documentation for all types of loans including commercial, construction and consumer loans.
- Coordinate the loan documentation process, including working in partnership with underwriters, loan administrators, customers, attorneys, appraisers, title company representatives and other applicable parties during all phases of the loan closing.
- Work under general direction, but in conformance with established policies and procedures, to ensure all regulatory, legal, and loan policy requirements are met in advance of preparing loan documents for approved loan requests.
- Prepare all necessary loan documents including Promissory Note, Business Loan Agreement, Construction Loan Agreement, Disbursement Request and Authorization, Resolutions, Loan Checklist, financing statements using information from the loan application, profile, and title policy.
- Prepare and review UCC’s, title and escrow documents, subordinations, modifications, collateral releases.
- Review credit files and determine additional documentation needs to support underwriting requirements, such as entity papers, credit reports, purchase contracts, lien searches, title policy, appraisal or evaluation, environmental questionnaire, survey, life insurance, and property liability insurance.
- Order and review third part reports based on loan and collateral type including title commitment, flood determinations, environmental reports, UCC searches, tax monitoring.
- Analyze title insurance commitment reports for acceptability and required endorsements to meet bank guidelines. Coordinate the clearing of title issues/exceptions that need to be removed and prepare title/escrow instructions.
- Ensure that the bank’s lien position on collateral has been accurately and timely perfected and protected through UCC filings, Deed of Trust recordings, and assignment of applicable insurance policies.
- If applicable, create escrow closing instruction and pre-closing conditions and any other conditions required for Lender/Borrower information.
- Communicate and resolve any supporting documentation issues or questions/clarification on the conditions/wording appearing in loan approval with Lending Unit and/or legal counsel.
- Receive signed loan documents and perform closing and funding activities including ensuring all loan documents are properly executed by authorized signer and reviewed/signed by Bank Officer. Process wire request, remit funds to pay off other lenders, obtain Deed of Trust recording confirmation, order tax contracts, UCC filing, set up and maintain tickler and monitoring databases. • Respond to internal and external inquiries in a timely and satisfactory manner (i.e., Lending Units, Loan Servicing, and legal counsel).
- • Track trailing documents (such as recorded Deed of Trust and Title policy, etc.)
- • Conduct LexisNexis Legal Reviews
- • Cross train in additional functions of the department when needed.
- • Complete all required regulatory training as assigned within deadlines established including BSA, Bank Security, and any other training as assigned, within required time limits and on an annual basis.
- • Other duties as assigned.
EDUCATION, SKILLS, AND EXPERIENCE REQUIREMENTS:
- Bachelor's Degree or minimum of five (5) years related bank or lending operations experience, with a concentration in loan documentation. Work-related experience must be a minimum of five (5) years and should consist of a loan processing background, including processing, preparing loan documents, booking, funding, and servicing all types of commercial and consumer loans. Educational experience should be business or financial industry related.
- Knowledge and training in loan documentation and loan servicing activities including terminology and elements/process required to close a loan transaction including borrowing-based lending, construction lending, letters of credit and multiple collateral properties.
- Expertise in Laser Pro or other similar products.
- Familiarity with customizing loan documents.
- Strong knowledge of related state and federal banking compliance regulations, bank operational and lending policies and procedures, and the bank’s products and services, including applicable lending regulations.
- Proficiency in preparing and reviewing closing documents.
- Experience with title and survey review, reviewing and redlining contracts and agreements.
- Proficiency in Microsoft Office Suite and real estate software applications.
- Paralegal certification preferred.
- FISERV experience a plus
- Working knowledge of various types of loans.
- Working knowledge of entity structures, organizational documentation, and state filing requirements with experience in reviewing business entity documents for completeness and accuracy.
- Strong analysis, research and verbal and written communication skills.
