The Opportunity
- Ensure that the organization takes necessary steps to comply with relevant laws, policies, and regulations in the process of achieving the goals of Vituity.
- Research and review laws, regulations, and industry guidance in order to prepare recommendations to guide Operations and Leadership in implementing new business processes, new regulatory requirements, and enhance compliance with healthcare regulatory environment.
- Draft analytical memos and provide recommendations on issues and matters related to health care regulatory compliance.
- Develop, launch, implement, and monitor state-specific compliance program initiatives across Vituity practice states.
- Draft data sharing/protection agreement(s) and review vendor agreements to comply with consumer privacy and consumer health data privacy regulations. Train Vituity business partners on laws and regulations and regulatory compliance with new state/site set-up and implementation.
- Draft, update, and monitor compliance policies, ensuring compliance with relevant state, federal, and local laws and regulations.
- Advise enterprise-wide teams including telehealth initiatives and consumer-facing innovations initiatives by ensuring compliance with regulations.
- Draft and review patient authorization and informed consent forms, notice of privacy practices, non-discrimination notices, telehealth consents, and practice-line specific disclosures.
- Lead advanced provider scope of practice document review in all Vituity practice states including drafting of agreements, annual review, and monitoring.
- Serve as regulatory compliance subject matter expert for Vituity-owned outpatient medicine facilities. Support/initiate workflow improvements and standardization for Vituity-owned outpatient medicine facilities.
- Provide regulatory updates to Vituity leadership and the Vituity Compliance & Ethics Committee meetings.
- Monitor Office of Inspector General (OIG) audit activity, workplan, and industry reports as well as Department of Justice investigations and communicate findings to business partners.
- Maintains open lines of communication with all relevant stakeholders in order to keep all parties informed of regulatory changes.
- Maintain thorough knowledge and understanding of the organization and be vigilant in order to stay aware of where possible regulatory breaches or issues may arise.
- Conduct annual and periodic reviews of Enterprise and Compliance policies and procedures.
- Conduct periodic review of regulatory compliance issue tracking grids and matrices regarding revenue cycle management billing, state abortion laws, medical chart release of information charged fees, state background check requirements, advanced provider scope of practice, and regulatory toolkits.
- Collaborate with SVP Compliance and other Compliance leaders, participate in the annual risk assessment and workplan development project to identify and manage risks enterprise wide.
- Implement, where appropriate, internal controls or procedures to measure and manage compliance risk.
- Identify compliance vulnerabilities and risks, and ensure timely, appropriate, and consistent responses to reported concerns, alleged violations of law or regulations, and/or conflicts of interest.
- Stay informed of and properly communicate any changes to or developments in health care related laws, regulations, standards, and guidance.
- Issue management and triage of compliance questions and hotline calls related to regulatory compliance.
- Participate in incident tracking process including documenting investigations, overseeing completion of corrective action plans, creating toolkits to use in analysis, and reporting on outcomes.
- Facilitate and operationalize Federal and State regulatory changes.
- Draft educational materials to highlight changes and updates to regulations and/or policies.
- Collaborate with Compliance team to develop central repository for regulatory research in Box, SharePoint, or appropriate repositories.
- Assist the Compliance Team and SVP Compliance with regulatory research and special projects as assigned.
- Support post-investigation educational, awareness, or remediation efforts as assigned.
- Lead and manage special enterprise projects on behalf of the Compliance Team.
- Support Compliance department with monitoring and auditing initiatives, including conducting internal reviews and audits.
- Develop and maintain expertise to further Regulatory Compliance and Compliance knowledge and understanding.
- Act as a steward by exhibiting sound ethical standards and consistently promoting a compliant culture.
- Research and author educational materials, Inside Track publications, white papers, and memoranda on regulatory compliance issues.
- Consult for or collaborate with Information Security Team on joint initiatives as needed including annual review of data retention schedules, migration to enterprise data to data retention solution system.
- Serve as a liaison to the legal department to assess regulatory risks and develop solutions for business partner clients.
- Participate in and lead Compliance Team projects and initiatives when requested.
- Develop expertise and perform research in compliance subjects and issues when requested.
Required Experience and Competencies
- Master's degree in Business Administration, Public Health, Law, Healthcare, English, or related field required.
- Minimum of five (5) years of experience in healthcare risk management, healthcare compliance, legal department, administrative agency, or equivalent field required.
- Experience managing audits or investigations by an outside auditor, external agency, or regulatory body preferred.
- Juris Doctor, Paralegal certificate, or legal training preferred.
- Certification in or coursework towards Healthcare Compliance (CHC) or privacy preferred.
- Proficiency in Microsoft O365 (Word, Excel, Outlook, SharePoint and PowerPoint) required; incident tracking warehouse proficiency strongly preferred.
- Expertise in compliance principles, including Office of Inspector General Seven Elements of an Effective Compliance Program.
- Strong working knowledge of laws and regulations governing healthcare, specifically Health Insurance Portability & Accountability Act (HIPAA), Fraud, Waste and Abuse, Stark Law and the federal Anti-Kickback statute, Emergency Medical Treatment and Active Labor Act (EMTALA), domestic consumer privacy regulations including CPRA, consumer health data regulations, state-level telehealth legislation and regulations, Medicare and Medicaid guidelines, regulations, and other guidance and standards.

We are excited to share the base salary range for this position is $117,110 - $149,315, exclusive of fringe benefits or potential bonuses. This position is also eligible to participate in our annual corporate Success Sharing bonus program, which is based on the company's annual performance. If you are hired at Vituity, your final base salary compensation will be determined based on factors such as skills, education, and/or experience.
