Our Trusts and Estates Department is seeking a Probate Litigation Associate with 3+ of experience. This Associate will primarily work in a practice that concentrates on Trust and Estate litigation with a focus on contested guardianships and conservatorships, will contests, trust disputes and breaches of fiduciary duty. Additionally, this position includes approximately 10-20% drafting estate plans. This Associate will gain experience working directly with clients and representing them in court proceedings as well as developing litigation tactics and negotiation strategies for the dynamic and fast-paced practice area of probate litigation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:

• Manage case progression: o Develop strategy and participate in strategy discussion. o Determine priorities and identify issues. o Delegate to and supervise work of paralegals and assistants. ? Review and edit paralegal drafts of probate documents for formal probates, informal probates, guardianships and conservatorships. • Draft substantive complaints, motions, oppositions, correspondence and other pleadings for contested matters.• Research and prepare accompanying memorandums for various probate issues. • Draft and respond to interrogatories, subpoenas and document requests. • Attend meetings and court hearings. • Draft estate planning documents, including but not limited to, wills, revocable trusts, durable powers of attorney, health care proxies and irrevocable life insurance trusts.
