About the Job
The HR Compliance Manager is responsible for ensuring that the organization’s human resource policies and practices are compliant with federal, state, and local employment laws and regulations. This role involves developing, implementing, and maintaining compliance programs, policies, and procedures, as well as monitoring and reporting on regulatory changes. The HR Compliance Manager works closely with HR leadership, legal counsel, and other key stakeholders to mitigate compliance risk and promote a culture of ethical business practices.
Key Responsibilities:
- Regulatory Compliance:
- Ensure company policies, procedures, and practices comply with federal, state, and local employment laws (e.g., FLSA, FMLA, EEO, ADA, etc.).
- Monitor and interpret changes in employment law and ensure that HR policies are updated accordingly.
- Manage compliance audits and lead internal investigations regarding compliance issues.
- Policy Development and Implementation:
- Develop, implement, and regularly update HR policies and procedures to meet regulatory and company standards.
- Provide guidance to HR and management on the interpretation and application of policies.
- Training and Education:
- Design and deliver compliance training for employees, managers, and HR personnel to ensure understanding and adherence to policies and regulations.
- Keep the organization informed about new developments in employment laws and regulations through regular communication.
- Audits and Reporting:
- Conduct regular HR compliance audits to ensure adherence to internal policies and external regulations.
- Prepare and present compliance reports to senior management.
- Ensure all employee records and data management practices comply with data privacy regulations (e.g., GDPR, CCPA).
- Risk Management:
- Identify and assess potential areas of compliance vulnerability and risk; develop and implement corrective action plans.
- Collaborate with legal counsel on HR-related compliance matters as needed.
- Investigations and Dispute Resolution:
- Oversee investigations of employee complaints or violations of regulatory requirements.
- Work with legal teams and external regulatory bodies to manage and resolve disputes or investigations.
- Cross-Functional Collaboration:
- Partner with departments such as Legal, Payroll, Benefits, Safety and Talent Acquisition to ensure alignment on compliance matters.
Minimum Education:CollegeMinimum Years of Experience:4-6Specific Qualifications:
- Education:
- Bachelor's degree in Human Resources, Business Administration, or related field (required).
- HR certifications such as SHRM-CP, SHRM-SCP, or PHR (preferred).
- Experience:
- 5+ years of experience in HR compliance or a similar role.
- Strong understanding of federal, state, and local employment laws and regulations.
- Experience managing HR audits, investigations, and reporting.
- Construction or related industry experience preferred.
Skills:
- Knowledge of employment related compliance regimes and enforcement (OFCCP, FLSA, immigration, ADA, ADAA, EEO/AA, e-verify, Title VII, GINA, ADEA, FMLA, UGESP, WARN, Vevraa, IRCA, FCRA, construction apprenticeship programs)
- Proficient in analyzing data
- Project management skills
- Experience implementing compliance programs/processes
- Experience conducting M&A diligence preferred.
- Experience using Dynamics and UKG a plus
- Data privacy, restrictive covenant experience a plus
