Ideal Candidate:
The ideal candidate for this position should possess strong legal writing skills, legal analysis experience, and heavy legal research experience. Must have extensive experience with Westlaw and Lexus/Nexis. During the interview process, the candidate must provide three (3) legal writing samples to the Federal Agency. Must possess an active EEO Counseling Certification. Minimum education requirement Bachelor's degree or higher in a Legal or Human Resources related field.
Position Requirements:
a. Must have mastery level of knowledge, skill and ability to finalize complex documents, reports, and presentations in Microsoft Word, Excel and PowerPoint, including ensuring a professional format and appearance suitable for filing with government agencies or submission to senior Agency leadership. By way of illustration, finalization includes formatting; extremely detailed proofreading for accuracy to the relevant file, spelling, grammar, and adherence to Agency style guides, templates, and model formats; checking citations and shepardizing cases; conforming documents to Agency formats, templates or guidance; creating cover sheets, tables of contents, lists of exhibits, timelines and synopses of events or documents; completing Agency checklists associated with the document, report or presentation; scanning, uploading, copying and or duplicating; tabbing materials; updating spreadsheets or databases that track the status of the document, report or presentation; pagination; labeling enclosures; and making the document, report or presentation 508-compliant. Document finalization may include creation of hard copy or electronic folders or hole-punched binders for obtaining interim and final approval; adding materials to comply with Agency checklists of items for inclusion in approval folders; and multiple rounds of making revisions and resubmitting for approval.
b. Must have at least a mastery level knowledge, skill and ability to conduct legal research and draft legal documents incorporating legal research. By way of illustration, conducting legal research includes issue spotting, determining search criteria, effectively operating legal search engines such as Westlaw, synthesizing and summarizing case holdings, and shepardizing cases. Legal writing includes drafting legal summaries of cases, describing the fact patterns, identifying and communicating the issues, stating the applicable rules, conducting analysis of the fact pattern against the rules/holdings to ascertain applicability to the matter at issue, and stating a conclusion as to how the research guides the Agency’s actions going forward. The Contractor should have a thorough knowledge of and skill in using legal citations.
c. Must have at least a mastery level knowledge, skill and ability to conduct EEO Counseling in a Federal agency; this individual must possess an active EEO Counseling certification.
d. Ability to research issues, identify relevant legal authorities and provide defendable solution(s) citing relevant authorities from Section 6 herein.
e. Ability to draft signature-ready documents following or adapting established agency formats.
f. Ability to learn the basic structure of a federal agency to determine sources of documents and to recommend resolutions of EEO complaints.
g. Knowledge of and the ability to quickly develop master level knowledge of Title 29 Code of Federal Regulations (CFR) Part 1614, Equal Employment Opportunity Commission (EEOC) Management Directive (MD) 110, and key EEO decisions of the EEOC and the U.S Supreme Court.
h. Expert level ability to analyze EEO complaints and EEO law to determine whether the legal elements of the alleged claim have been met and likely remedies.
i. Ability to draft complaint processing documents and the ability to quickly develop master level ability to draft complaint processing documents.
j. Ability to use MS Outlook, Word, Excel and Adobe Professional.
k. Verbal communication skill to speak with different levels throughout a federal agency, with outside agencies and with attorneys or other representatives.
l. Communication skill to listen to and speak with individuals regarding their EEO concerns when the individual is upset or demanding.
m. Ability to work as a part of a team and accept a variety of feedback on deliverables.
n. Desirable but not essential: Certification to conduct EEO counseling in the Federal sector.
o. Desirable but not essential: Certification to conduct EEO investigations in the Federal sector.
P. Desirable but not essential: Certification to conduct EEO mediations and Alternative Dispute Resolution (ADR) in the Federal sector.
q. Desirable but not essential: Experience with an on-line complaint tracking system.
