We are seeking a seasoned Employee Benefits Attorney or Of Counsel to join our dynamic legal team. This is an exceptional opportunity for a candidate with deep expertise in retirement plans, employee benefits, and M&A to make a significant impact on our organization. The successful candidate will be responsible for providing legal advice and guidance to our clients, ensuring their benefits programs are compliant with federal and state laws. This is a permanent, full-time position, and the candidate must have a minimum of 5 years of relevant experience.
Responsibilities:
1. Provide legal counsel on a wide range of employee benefits and executive compensation matters, including health and welfare plans, retirement plans, and other employee benefit plans.
2. Advise clients on the design, implementation, and operation of benefit plans.
3. Ensure compliance with ERISA, HIPAA, ACA, and other applicable laws and regulations.
4. Represent clients in audits and investigations by federal and state agencies.
5. Provide advice on benefits and compensation matters in mergers and acquisitions, including due diligence, negotiation of purchase agreements, and post-closing integration.
6. Draft and review plan documents, summary plan descriptions, participant communications, and other plan-related documents.
7. Stay updated on new legislation and regulatory rulings impacting employee benefits.
8. Develop and deliver training sessions to clients on employee benefits legal issues.
Qualifications:
1. Juris Doctor (JD) degree from an accredited law school.
2. A minimum of 5 years of experience in employee benefits law, with a focus on retirement plans, health and welfare plans, and M&A.
3. Admission to the state bar.
4. Strong knowledge of ERISA, HIPAA, ACA, and other laws and regulations related to employee benefits.
5. Experience in dealing with federal and state agencies, including the IRS and DOL.
6. Excellent negotiation, drafting, and analytical skills.
7. Strong communication and interpersonal skills, with the ability to explain complex legal issues in a clear and understandable way.
8. High level of professionalism and ethical standards.
9. Ability to work independently and as part of a team.
10. Proven ability to manage multiple projects, prioritize tasks, and meet deadlines.
11. Strong commitment to client service and excellence in all aspects of work.
