This position offers a base salary typically between $228,000 and $350,000. The position may be eligible for a role specific variable or performance based bonus and or other compensation elements. Description
The Director and Sr Counsel II, Value and Access will primarily partner with the organization’s Value & Access department, focusing on government pricing and contracting, trade, specialty pharmacies and communications with Payers. May also partner with various therapeutic areas on promotional and scientific communications and other strategic initiatives related to market access, including 340B.
Provides a broad range of legal services, typically to Clients at the VP level who control business activities and reporting to them. Level of counseling provided requires broader understanding of the impact decisions may have on the overall business, as the risks associated with incomplete advice are high. Duties include drafting of legal documents and provision of legal counsel. Should have acquired knowledge of law in at least two specialized areas (e.g., patents, FDA Regulatory, commercial, litigation, etc.) critical to maintaining business operations and be very knowledgeable about the products, competitors and regulatory environment of the company's businesses. Mentors more junior attorneys in areas of expertise.

Duties & Responsibilities
+ Serving as lead counsel for our 340B function concerning legal, regulatory, and compliance issues associated with federal programs, government price reporting requirements across the portfolio of medicines.
+ Serving as counsel for our Value & Access functions advising on Anti-Kickback Statute, False Claims Act, and competition law matters.
+ Providing strategic legal counsel to senior management on product pricing and access matters, with significant interaction with senior leaders across the organization.
+ Provide advice and guidance on issues pertaining to best price, WAC, AMP, ASP, and federal and state price reporting.
+ Preparing, reviewing, and negotiating complex government, payor, and trade agreements.
+ Expert understanding of state and federal laws, regulations and policies in several specialized legal areas; strong working knowledge of laws, regulations and policies in at least one other specialized legal area; ability to interpret and apply such laws, regulations and policies to inform business activities. Specialized legal areas within an attorney’s expertise may include: Intellectual Property, Regulatory, Trade, Compliance, Contracting, Environmental, Employment, Litigation and/or Antitrust.
+ Influences clients by identifying and communicating to clients risks associated with complex business activities within lawyer's broad understanding of several specialized legal areas
+ Partners with clients by considering immediate business/legal issues in a broader business context and identifying broader business purposes and objectives; proactively applies broad legal expertise to address both the specific business activity and influence the broader business purposes and objectives; developing alternative fact hypotheticals and legal solutions to clarify options and enable the achievement of successful business outcomes.
+ Expected by business management to take the lead in negotiating on behalf of client to achieve solutions that attain business objectives.
+ Confers with other in-house and supervises outside counsel where appropriate.
+ Manages (either directly or indirectly) administrative assistants, paralegals and other personnel within department. Mentors and/or trains more junior attorneys, paralegals, administrative assistants and/or other personnel within department.
+ Strong knowledge of national business environment in which client competes. Keeps current with evolving legal and business issues within lawyer’s broad expertise, promotes corporate policies and proactively monitors client’s business environment.
Requirements
+ Juris Doctorate degree from an accredited law school
+ At least eight (8) to ten (10) years relevant legal experience; admission to at least one State bar.
+ Should have acquired knowledge of law in at least two specialized areas (e.g., patents, FDA Regulatory, commercial, litigation, etc.) critical to maintaining business operations and be very knowledgeable about the products, competitors and regulatory environment of the company's businesses.
+ Excellent oral and written communication skills.
+ Excellent organizational skills; demonstrates discretion and ability to maintain confidentiality of information.
+ Proficiency in government price reporting requirements, including AMP, Best Price, ASP, and 340B, as well as federal health care program contracting (e.g Medicaid, VA, etc.).

+ Must be legally authorized to work in the United States without restriction.
+ Must be willing to take a drug test and post-offer physical (if required).
+ Must be 18 years of age or older.
