Key Responsibilities:
Enforcement of Loan Agreements:
Drafting and enforcing contracts related to loans, mortgages, and credit.
Filing lawsuits to recover money owed.
Debt Collection:
Representing creditors in negotiating repayment plans or settlements.
Pursuing legal remedies to collect debts (e.g., garnishments, liens).
Foreclosures and Repossessions:
Handling foreclosure proceedings on properties securing a defaulted loan.
Overseeing repossession of assets such as vehicles or equipment.
Bankruptcy Representation:
Advocating for creditors in bankruptcy proceedings to ensure they recover as much as possible.
Filing claims and contesting debtor discharge when appropriate.
Litigation and Negotiation:
Suing debtors for breach of contract or default on obligations.
Negotiating with debtors or their attorneys for out-of-court resolutions.
Regulatory Compliance:
Advising creditors on compliance with federal and state laws, such as the Fair Debt Collection Practices Act (FDCPA).
