Position Summary
This position is based at InterDigital's worldwide headquarters in Wilmington, Delaware (part of the greater Philadelphia metropolitan region), USA, but we may consider a remote location, and will require domestic and international travel. The successful candidate will join a dynamic and respected legal department with over 100 members and will be handling all litigation related to InterDigital's OTT licensing program and other legal proceedings involving the company and its subsidiaries. The successful candidate will be tasked with designing (in conjunction with in-house experts and outside counsel) and implementing a global intellectual property litigation strategy for the company related to various licensing programs. The successful candidate will have the opportunity and be expected to evaluate the internal and external litigation needs and resources of the company and to implement necessary changes and additions. This is a worldwide role and experience with intellectual property litigation outside the US is preferable, but not required. This position will report directly to the VP, Head of Litigation and will have significant contact with other members of the company's management team, including senior executives.
Responsibilities
- Worldwide Litigation Strategy and Oversight
- Enforcement of Standard Essential Patents, or SEP's, including providing advice regarding FRAND (Fair, Reasonable and Non-Discriminatory) litigation strategies, to drive the company's licensing programs focused on video technologies, but may have additional responsibilities in other markets such as mobile, video and other consumer electronics.
- Defend the company against existing and any new intellectual property (IP), antitrust, commercial, or other litigation worldwide initiated by third parties
- Manage and direct external counsel providing support for litigation and other legal proceedings involving the company and its subsidiaries
- Working closely with the company's Director of Legal Operations and Finance Department, to help the VP, Head of Litigation manage significant budget for internal and external spend involving the company and its subsidiaries
- Working closely with the company's licensing professionals, support business and/or settlement negotiations with prospective licensees worldwide
The successful candidate will have at least 10 years of directly relevant IP litigation experience, including within a law firm. They will have experience serving as first chair and lead counsel in high-value patent enforcement litigation both within and outside the US. The ideal candidate will have experience advising patent holders, preferably SEP holders, and with FRAND litigation, in the technology industry or other IP-intensive businesses. Experience with litigation in China, Europe and other ex-US jurisdictions is also preferred.

Educational/Professional Requirements
- Bachelor's degree or equivalent plus law degree
- Law degree from top-tier law school preferred
- Current state bar membership or other relevant license to practice law
- 10+ years related experience at a law firm and/or in a corporate law department
- Experience serving as counsel in high-value patent enforcement litigation, including FRAND litigation
- Experience advising patent holders, with a preference for having advised SEP holders

A reasonable estimate of the current salary range specific to New York/CA is $190,000 - $285,000 /annually + discretionary incentive bonus, benefits and may include other forms of compensation components such as long-term incentives. Compensation for the role will depend on a number of factors, including a candidate's qualifications, skills, competencies and experience and may fall outside of the range shown.
