About the Job
Responsible for the administration of Risk and Claims Management. Serves as legal counsel within the hospital and provide legal services, advice and assistance to various clinical and staff departments.
Responsibilities:- Assist in the management of litigation caseload including medical malpractice, workers compensation, property, automobile claims (excluding employment claims and litigation) and certain other insurance covered claims for all OBHS campuses;
- Assist the Chief Risk Officer, in exercising responsibility for the selection, evaluation, retention and use of outside legal counsel in connection with medical malpractice, workers compensation, property, automobile, and certain other insurance covered claims. Assist with the assignment of work to such outside law firms and evaluate the quality of each firm’s work product and cost effectiveness.
- Functions as a liaison between Hospital and its malpractice/negligence insurers and investigators; keeps them apprised of the Hospital’s wishes in the handling of malpractice and negligence cases;
- Along with appropriate leadership, assist with decision-making concerning case settlements and case negotiations, Medical Malpractice Panels, examinations before trial, etc;
- Assist in or delegate investigation of risk incidents/occurrences as needed. Participate in any associated Root Cause Analysis forums. Prepare disclosures of reportable incidents to governmental agencies as needed.
- Provide review of subpoenas and other legal documents;
- Provide review of contracts as requested;
- Acts as a resource concerning medical/legal issues within the Organization including but not limited to medical staff issues, provider reporting/discipline, patient care and privacy issues, informed consent, end of life care, and human subject research;
- Assist Risk Management Departments and Risk Management Committees at all OBHS campuses;
- Provides in-servicing to new employees on risk management, informed consent and patient care and privacy issues, as required;
- Assist in providing direction to Directors of Risk Management in management of claims and other institutional risk issues;
- Reviews regulations and updates policies pertaining to risk management , patient care and privacy issues, informed consent, end of life care, as needed;
- Serves on boards, committees, and work groups (internal and external clients) as needed or as assigned.
- Performs other duties as assigned.
Education:
- Juris Doctor required.
Experience:
- Minimum of five (5) years legal experience in a complex healthcare setting is required.
Knowledge and Skills:
- Experience leading and coordinating work with others, such as Paralegal position.
- Good attention to detail.
- Strong contract writing skills.
- Proven and effective communication skills.
Licenses/Certifications:
- Admission to the New York State Bar.
Physical Requirements:
- Ability to work long hours.
- Sedentary work involves sitting most of the time.
