They are seeking an experienced Plaintiff Medical Malpractice Attorney with substantial trial experience to join their dedicated legal team.
Key Responsibilities:
- Case Management: Handle a caseload of medical malpractice cases from intake through trial, including investigation, discovery, depositions, and settlement negotiations.
- Trial Advocacy: Serve as lead or co-counsel in courtroom trials, delivering persuasive arguments, conducting direct and cross-examinations, and working closely with clients and expert witnesses. Prepare and execute comprehensive trial strategies to secure favorable verdicts for plaintiffs.
- Client Representation: Meet with clients to assess claims, provide legal counsel, and manage client relationships throughout the litigation process. Maintain regular communication with clients to keep them informed on case progress and strategy.
- Legal Research & Writing: Draft pleadings, motions, and legal briefs. Conduct in-depth legal research on medical malpractice laws and precedents to build compelling cases.
- Expert Collaboration: Collaborate with medical experts to develop case theories, review medical records, and prepare expert witnesses for deposition and trial testimony. Ensure the accuracy and relevance of expert opinions.
- Settlement Negotiation: Engage in settlement discussions and mediation on behalf of clients to negotiate fair and just compensation. Evaluate the risks and benefits of settlement offers.
- Pre-Litigation: Conduct pre-litigation investigations, interview witnesses, and gather medical records to assess the viability of claims.
- Team Collaboration: Work closely with paralegals, junior attorneys, and support staff to manage deadlines, prepare for trial, and ensure the highest standard of legal service.
Qualifications:
- Education: Juris Doctor (JD) from an accredited law school.
- Bar Admission: Active member in good standing of the [State] Bar.
- Experience: Minimum of 5 years of experience in plaintiff-side medical malpractice litigation, with substantial trial experience (first-chair or second-chair).
- Trial Skills: Proven success in managing cases through trial, with strong oral and written advocacy skills.
- Legal Expertise: In-depth knowledge of medical malpractice law, healthcare regulations, and understanding of medical terminology and procedures.
- Technical Skills: Proficient in legal research tools (e.g., Westlaw, LexisNexis) and case management software.
Preferred Qualifications:
- Expert Witness Experience: Demonstrated ability to work with medical experts, including preparing and presenting expert testimony in trial.
- Medical Knowledge: Familiarity with medical concepts, anatomy, and medical standards of care.
- Client-Focused: Strong interpersonal skills with the ability to effectively manage and empathize with clients experiencing emotional distress.
