Job Description: Real Estate Attorney
Position Overview:
We are seeking an experienced In-House Commercial Real Estate Attorney with a minimum of 10 years of experience in South Florida. The successful candidate will be responsible for providing comprehensive legal support on all aspects of our commercial real estate transactions and operations. This role requires a deep understanding of South Florida real estate laws and regulations, excellent negotiation skills, and the ability to manage complex real estate projects from inception to completion.
Key Responsibilities:
- Draft and Negotiate Real Estate Contracts
- Prepare and negotiate commercial real estate contracts, leases, and agreements to ensure favorable terms and compliance with legal standards.
- Due Diligence
- Conduct thorough due diligence, including reviewing property titles, surveys, and other essential documents to identify and mitigate potential risks.
- Property Acquisitions and Dispositions
- Provide expert advice on property acquisitions, dispositions, and development projects, ensuring alignment with company goals and legal requirements.
- Zoning and Land Use
- Handle zoning, land use, and entitlement matters, including representing the company in negotiations with government agencies and private parties.
- Construction and Architect Agreements
- Review and negotiate construction contracts and architect agreements to protect the company's interests and ensure project success.
- Real Estate Financing
- Advise on real estate financing, including drafting and negotiating loan agreements and security instruments.
- Dispute Resolution
- Manage and resolve real estate disputes and litigation, working to achieve favorable outcomes for the company.
- Interdepartmental Collaboration
- Collaborate with other departments, such as property management and leasing, to address real estate-related matters.
- Regulatory Compliance
- Stay informed about changes in real estate law and regulations in South Florida to ensure the company's compliance.
- Legal Counsel
- Provide strategic legal counsel to executive management and other stakeholders on various real estate matters.
- Manage Outside Counsel
- Oversee and manage the work of outside counsel and vendors on real estate matters.
- Legal Strategy Development
- Develop and implement effective real estate legal strategies and best practices.
- Commercial Leases
- Negotiate and draft commercial leases, including office, retail, and industrial leases, and handle lease amendments, renewals, and terminations.
- Title Review and Closing Work
- Review title commitments, title policies, and surveys.
- Clear title exceptions and resolve title issues.
- Draft and negotiate closing documents, such as deeds and affidavits.
- Oversee closing processes to ensure timely and efficient closings.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school.
- Active membership in good standing with the Florida Bar.
- Minimum of 10 years of experience in commercial real estate law in South Florida.
- Strong knowledge of South Florida real estate laws, regulations, and market trends.
- Proven track record of successfully negotiating complex real estate transactions.
- Excellent analytical, problem-solving, and communication skills.
- Ability to work independently and collaboratively in a fast-paced environment.
- High level of integrity and professional ethics
