About the Job
- Receives for civil process over eighty different types of civil and domestic court actions, writs of execution, writs of habeas corpus, miscellaneous writs, foreclosures, petitions, bond validations, injunctions, garnishments, condemnations, foreign judgments submitted to the clerk's office.
- Receives and processes all juvenile court cases; maintains strict confidentiality of records.
- Reviews and identifies each type of civil and juvenile action based upon substance and statutory procedural requirements.
- Reviews and determines if all venue and jurisdictional requirements have been met for each civil and juvenile type submitted for processing.
- Accepts or rejects each action submitted based upon determination of whether all legal requirements and mandatory documents have been submitted.
- Processes each accepted case by entering all data elements into computerized court management system, random assignment of judge assignment and case number.
- Supplies all mandatory information based upon case type on civil case information initiation and disposition forms to be submitted electronically to the Georgia superior court clerk's authority.
- Supplies all mandatory juvenile court case information through electronic transmission to state juvenile court system.
- Monitors and tracks cases to assure successful processing and that all mandatory time limits and restrictions have been met. Issues rule nisi orders for civil court cases; authorizes under stamped signature of assigned superior court judge.
- Assesses, calculates and collects all civil filing fees as required by law based upon case type; accounts and balances daily receipts for disbursement to fiscal division of clerk's office.
- Coordinates with office of dispute resolution to assure mandatory mediation are scheduled and heard prior to court hearing or adjudication.
- Communicates with and monitors case track with attorneys, judges, state agencies, sheriff's department, local newspaper to assure that all service and publication requirements have been met.
- Issues all required summons and subpoenas mandated for civil and juvenile court action.
- Reviews all garnishment actions to determine if proper judgment has been filed, that amount due is accurately set forth, that names of courts properly rendered; verifies that sworn affidavit has been completed and submitted.
- Approves affidavit on behalf of assigned superior court judge; issues summons and forwards all mandatory service to sheriff; monitors and abides closely to all time conditions.
- Tracks and deducts court cost for each garnishment proceeding for each case submitted. Researches and provides onsite and telephonic assistance to judges, court personnel, attorneys, general public and others for case status.
- Provides guidance to pro se litigants submitting civil actions without assistance of counsel as to procedures, mandatory documentation and time limits for each action.
- Processes civil actions filed with paupers affidavit upon approval of superior court judge.
- Receives and reviews notices of appeals for civil actions to evaluate for legal sufficiency and conformance with uniform supreme court rules and uniform court of appeals rules.
- Evaluates notice to determine if interlocutory, discretionary, direct or joint appeal as determined by review of relevant law.
- Computes a total bill of costs prior to processing of appellate case file and mails to appellate by registered or certified mail for overnight delivery.
- Prepares appellate record in accordance with uniform Supreme Court and Court of Appeals rules.
- Prepares index of record in exact format, style and content as required by law.
- Transmits the appeal, including index, copy of record and original transcript within time period allowed by law.
- Gathers all required evidence, including testimony, documents, objects, photographs, which provide proof substantiating a case.
- Assures security and safekeeping of all transcripts and evidence attached to appeal.
- Submits to appellate court all pleadings, the trial transcript, and a description or photograph of each piece of physical evidence within twenty days of filing of notice of appeal.
- Certifies each volume and transcript separately; ensures that each transcript is certified by court reporter.
- Maintains communication with parties and appellate courts until appellate process is complete.
- Operates multi-line phone system.
